1. The Promoter of the Competition is Ecofund Queensland Pty Ltd, ABN 92 142 542 774 located at Level 3, 120 Edward Street, Brisbane, QLD 4000, Australia.
2. Information regarding the Prize and how to enter the Competition form part of these Conditions of Entry. By entering into the Competition, a Participant is taken to have accepted these Conditions of Entry and agrees to be bound by them.
3. The Competition commences at 17.30 (AEDT) on 7 November 2011 and closes at 15.00 (AEDT) on 9 November 2011 (Promotional Period).
4. Entry is open only to Australian residents aged 21 years or older (Participants) and who:
a) are able to take the Prize during the period specified by the Promoter; and
b) are not directors, officers or employees (including members of the immediate family of such persons) of the Promoter.
5. Each Participant who enters the Competition during the Promotional Period will be entered into the draw. One Participant will be drawn at random to become the winner. The draw will take place at the Promoter’s booth in the trade fair area at Carbon Expo Australasia 2011, Melbourne Convention & Exhibition Centre (Promoter’s Carbon Expo Booth) on Wednesday 9 November 2011, during the scheduled afternoon tea session (between 15.30 and 16.00 AEDT). Participants need not be present at the draw.
6. There is one prize. The prize is a trip for the winner and their companion (who must be aged 21 or over) to Noosa, Queensland, which must be taken between 6 February 2012 and 31 March 2012 on dates agreed to by the Promoter. The prize consists of:
- return economy airfares (including taxes) from Sydney or Melbourne (if required) to Brisbane, Queensland and return transfers between Brisbane airport and The Sheraton Noosa Resort & Spa for the winner and their companion;
- 2 nights twin share ‘Superior Room’ accommodation at The Sheraton Noosa Resort & Spa; and
- a half day guided tour of selected Noosa biosphere highlights and the Promoter’s carbon farming project, including transport.
The Prize is valued at up to $4,500 (including GST) depending on the winner’s point of departure.
7. Flights, accommodation and any other activities are subject to booking and availability and must be taken on dates agreed to by the Promoter (including, if applicable, the winner and their companion being able to make their own way to and from their departure airport by the time and date specified by the Promoter. Peak periods and Australian public holidays are excluded. All costs and expenses associated with the Prize which are not specified to be included in the Prize, including but not limited to any meals, additional transfer costs, insurance, spending money, mini bar and room service costs, optional hotel costs, and other ancillary costs, are the responsibility of the winner and their companion, as incurred. If the winner chooses to extend the dates of their travel prize, they do so at their own cost and the Promoter will not be responsible for any such associated costs. The winner and their companion must depart and return at the same time. All elements of the Prize are subject to any additional terms and conditions specified by the Prize supplier/s.
8. Any taxes (other than GST if any), that may be payable as a consequence of the winner receiving the Prize are the sole responsibility of the winner. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought.
9. The Prize is not transferable or exchangeable, whether for cash or otherwise. The Promoter takes no responsibility for any variation in the value of the Prize. If for any reason the winner or their companion does not take an element of the Prize at a time stipulated by the Promoter, then that element of the Prize will be forfeited.
10. The winner must comply with all requirements and directions of the people responsible for the conduct of the Noosa biosphere tour and must ensure that their companion also complies.
11. The Promoter may in its absolute discretion prohibit a Participant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize to a winner and their companion if the Participant or the winner (or their companion), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related entities (or of the business of the Promoter or any of its related entities), is contrary to law or is otherwise inappropriate.
12. To the extent that a situation or issue arises which these Conditions of Entry make no provision or in relation to which the Conditions of Entry are unclear, the Promoter reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.
How to enter
13. To enter the Competition, a Participant must complete the entry form available at the Promoter’s Carbon Expo Booth by providing all requested details including (but not limited to) the correct answer to the specified question, their full name, address, daytime phone number, email address, and agreement to these Conditions of Entry indicated by marking the checkbox, and submit the fully completed entry form into the entry box located at the Promoter’s Carbon Expo Booth.
14. A Participant may only enter the Competition once.
15. The Promoter reserves the right to verify the validity of entries and to disqualify any Participant who, in the opinion of the Promoter:
a) tampers with the entry process;
b) submits an entry that is not in accordance with these Conditions of Entry;
c) has engaged in conduct in entering the Competition which is fraudulent or damaging to the goodwill or reputation of the Competition and/or the Promoter. This includes, but is not limited to, Participants using multiple email addresses, postal addresses or PO Box addresses to enter the Competition.
How winners will be determined
16. The winner of the Prize will be selected at random from all valid entries.
17. The winner will be notified by telephone and email, and the winner’s name will be published in The Australian newspaper on 15 November 2011 and at www.ecofund.net.au.
18. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the result of the Competition.
19. The Promoter may require the winner to provide proof of their identity, age and residency in order to claim the Prize. Identification that is considered suitable for verification is at the Promoter's discretion. In the event that the winner cannot provide suitable proof to the Promoter of their identity, age and/or residency, the winner will forfeit the Prize.
20. If the winner does not accept or claim the Prize by 17.00 (AEDT) on 9 December 2011, the Prize is forfeited. There will be no second chance draw.
21. The winner will be required to sign a letter of declaration stating receipt of the Prize regardless of their intentions for the Prize post receipt. Refusal to sign this declaration will be taken as a forfeit of the Prize.
22. If for any reason the Competition is not capable of being run as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prize and these Conditions of Entry, subject to State legislation.
23. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
b) any theft, unauthorised access or third party interference;
c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter);
d) any variation in the value of the Prize as stated in these Conditions of Entry;
e) any tax liability or any other statutory charge, fee or cost incurred by a winner or Participant;
f) participation in the Competition; and
g) a Prize.
24. To the furthest extent permitted by law, the Promoter:
a) makes no warranties and accepts no liability in relation to the Prize, its condition or fitness for any purpose; and
b) is not responsible nor liable for the loss of or damage to the Prize.
25. If for any reason the Prize is not available, the Promoter reserves the right to substitute it for another item of an equal or greater value.
26. It is a condition of accepting the Prize that the winner and their companion agree to participate in and co-operate as required with all reasonable media editorial requests relating to the Competition, free of charge, including but not limited to, being interviewed, photographed and/or filmed. The Promoter reserves the right to publish the name and photographs of the winner.
27. All entries become the property of the Promoter. By entering the Competition, the Participant agrees that the Promoter may use the Participant's personal information for the purposes of conducting the Competition, identifying the winner and in any media for promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. The Participant's consent includes the storage of their personal information on the Promoter’s database and use of this information in any future promotional, marketing and publicity activities to provide information to the Participant regarding the Promoter’s products and services, including by email, subject to the Privacy Act 1988 (Cth). Participants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address in paragraph 1.
28. This competition is in no way sponsored, endorsed or administered by, or associated with, Carbon Expo Australasia. Participants are providing their information to the Promoter and not to Carbon Expo Australasia. Each Participant completely releases Carbon Expo Australasia from any and all liability.
Definitions
In these Conditions of Entry:
a) "Competition" means the Win a Trip to Noosa Competition.
b) “Immediate family” means spouses, parents, children or siblings, whether or not they live in the same house as the director, officer or employee of the Promoter.
c) "Participant" has the meaning given in paragraph 4 above.
d) "Prize" means the prize referred to in paragraph 6 above or any substitute prize of an equal or greater recommended retail value.
e) "Promoter" means Ecofund Queensland Pty Ltd.
f) “Promoter’s Carbon Expo Booth” has the meaning given in paragraph 5 above.
g) "Promotional Period" means the period of time referred to in paragraph 3 above.
